Global Hosting Web Services reserves
the right to change or alter this TOS at any time, without
notice to the customer.
Server Use
Global Hosting Web Services will not tolerate inappropriate
use of our servers and resources. We reserve the right
to suspend a customer's account at our sole discretion
without prior notice.
Any domain found to be jeopardizing server performance
and thus affecting normal server operation or service
to other Global Hosting customers will be suspended
without prior notice. User may be contacted before suspension
if performance isn't terrible however in good judgment,
some sites may be suspended for fairness of other clients
on the server.
Content Policy
Global Hosting Web Services does not allow any illegal
material to be stored on our servers.
Transmission, storage, or presentation of any information,
data or material in violation of any United States Federal,
State or City law is prohibited. The subscriber agrees
to indemnify and hold harmless Global Hosting Web Services
from any claims resulting from the use of the service
which damages the subscriber or any other party.
Adult material and sex-related links or merchandising
is prohibited on Global Hosting servers. This includes
sites that contain pornography, or links to adult content
elsewhere. The designation of "adult material"
is left entirely to the discretion of Global Hosting
Web Services
Also prohibited are sites that promote any illegal
activity or present content that may be damaging to
Global Hosting Web Services servers or any other server
on the internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites
- Adult Content (unless permission received)
Global Hosting Web Services will be the sole arbiter
as to what constitutes a violation of this provision.
Any deliberate attempt to cause damage to Global Hosting
Web Services or any other Internet servers will result
in immediate account deactivation without prior notice.
No refund will be issued.
Indemnification Policy
Global Hosting Web Services reserve the right to refuse
service to anyone for any reason not prohibited by law.
We also reserve the right to terminate service to any
customer for any reason not prohibited by law. You agree
to use all Global Hosting Web Services services at your
own risk. Global Hosting Web Services specifically disclaims
all warranties of merchantability and fitness for a
particular purpose. In no event shall Global Hosting
Web Services be liable for any loss, or loss of data,
or other commercial damage, including but not limited
to special, incidental, consequential or other damages.
Customer agrees that it shall defend, indemnify, save
and hold Global Hosting Web Services harmless from any
and all demands, liabilities, losses, costs and claims,
including reasonable attorney's fees asserted against
Global Hosting Web Services, its agents, its customers,
officers and employees, that may arise or result from
any service provided or performed or agreed to be performed
or any product sold by customer, it's agents, employees
or assigns. Customer agrees to defend, indemnify and
hold harmless Global Hosting Web Services against liabilities
arising out of:
- any injury to person or property caused by any products
sold or otherwise distributed in connection with Global
Hosting Web Services' servers;
- any material supplied by customer infringing or
allegedly infringing on the proprietary rights of
a third party;
- copyright infringement
- any defective products sold to customer from Global
Hosting Web Services' server.
Bandwidth and Disk Usage
Customer agrees that bandwidth and disk usage shall
not exceed the number of megabytes per month for the
Services ordered by Customer on the Order Form (the
"Agreed Usage"). Global Hosting will monitor
Customer's bandwidth and disk usage. Each extra gigabyte
of bandwidth exceeding the limit will be billed at $1.00
per gigabyte. Customer will be billed $1.00 for each
extra 100megs space exceeding the limit for over 3 days.
Over-usage fees will be billed at the end of the month.
Failure to pay will result in immediate account termination.
Cancellations and Refunds
The customer may choose to cancel at anytime. To cancel
your account, send a ticket to the billing department.
To ensure you are not billed for the following month
please contact us or submit your ticket within 7 days of
your recurring date and no latter then 24 hours before
that date. All monetary transactions are in $US dollars.
